Terms of Sale

CONTRACT VALIDITY

1.1 These terms (hereinafter – the Contract) are the only valid agreement between MB Gastroware (Company code 307120254, VAT payer code LT100017693418, Tulpių g. 9, LT-91210 Klaipėda, email [email protected]) and the buyer (hereinafter – the Customer). All other agreements are invalid unless agreed in writing.

1.2 An order is considered accepted only after MB Gastroware confirms it.

1.3 MB Gastroware may change these terms by publishing a new version on its website.

GOODS

2.1 Product descriptions and specifications are provided on the MB Gastroware website or in the current catalog.

2.2 Goods are supplied according to stock availability; if goods are unavailable, MB Gastroware may replace them with a similar product only with the customer’s consent.

2.3 Orders may be canceled if goods are not in stock.

2.4 The Customer confirms that they are at least 18 years old.

PRICES AND PAYMENT

3.1 Product prices are indicated on the website or in the current catalog. Delivery and/or insurance fees may be applied additionally.

3.2 Prices are quoted excluding VAT unless otherwise stated. VAT is applied according to current legislation.

3.3 If an incorrect price is stated, MB Gastroware is not obliged to fulfill the order.

3.4 Payments are accepted by all methods indicated on the website. MB Gastroware may hold the order until full payment is received.

3.5 The late payment penalty rate is 8% of the order value.

DELIVERY

4.1 Delivery price and conditions are provided on the website.

4.2 Goods are delivered within 5–9 business days from order confirmation.

4.3 MB Gastroware assumes no responsibility for delays if they do not depend on the company’s actions.

4.4 Risk for goods passes to the customer upon delivery, ownership rights – only after full payment.

4.5 Goods must be inspected upon delivery, defects must be noted on the delivery note and reported to MB Gastroware within 24 hours.

4.6 Large equipment is delivered to the first floor doors of the building unless otherwise specified.

RETURNS AND WARRANTY

5.1 Private consumers (B2C) have the right to refuse the order within 14 days of receiving the goods. In such cases, MB Gastroware may provide a full refund. Contact by email [email protected].

5.2 For business customers (B2B), returns are not processed except for defective goods or cases where it is mandatory under Lithuanian law.

5.3 Goods are covered by a 1-year warranty or the manufacturer’s specified warranty. The warranty is valid only if the goods were used according to instructions and properly maintained.

5.4 The warranty does not apply if damage occurred due to improper use or installation.

5.5 Old electrical appliances may be disposed of by prior agreement and according to WEEE requirements.

5.6 Consumer rights legislation is not violated by these terms.

TERMINATION

6.1 MB Gastroware may cancel the order if payment is not received.

6.2 The Company may terminate the contract if the Customer becomes insolvent.

6.3 Delivery may be suspended due to force majeure circumstances.

6.4 An order may be canceled if it is suspected that the Customer does not have the right to purchase certain goods (e.g., knives).

LIABILITY

7.1 The maximum liability of MB Gastroware is the amount paid for the goods.

7.2 The Company is not liable for indirect or consequential losses, except in cases where laws do not allow this.

INTELLECTUAL PROPERTY AND CONFIDENTIALITY

8.1 The Customer may not use or distribute MB Gastroware goods without permission if they are subject to copyright.

8.2 Customer data is processed according to MB Gastroware’s privacy policy.

JURISDICTION

9.1 This contract is governed by the laws of the Republic of Lithuania. Disputes are resolved in Lithuanian courts.

9.2 If any term becomes invalid, the remaining terms remain valid.

9.3 This is the entire agreement between the parties. It supersedes all previous verbal or written agreements.

9.4 MB Gastroware may transfer the performance of this contract to third parties.

9.5 MB Gastroware’s delay in applying these terms does not grant the Customer any rights.

9.6 Notices are sent to registered addresses or by email and are considered received after 48 hours.
